1. What is a Business License Tax?

A business license tax is an annual non-regulatory licensing fee levied by individual California cities and counties for the privilege of conducting business within a particular city or county jurisdiction. Business license fees are due and payable prior to commencing business within a particular city or county. The fees assessed are intended to raise revenue for the general operating requirements of individual cities and counties. City of Placentia business license revenue is used to help fund critical municipal services such as police, fire, public works and general government services.

2. Who is required to have a Business License Tax?

Any individual, corporation, sole proprietor, partnership or any entity that wishes to conduct business within the City of Placentia must secure a business license. Placentia Municipal Code §6.04.030 states that no person shall engage in business or transact and carry on a business, trade, profession, calling or occupation in the City without first having procured a license from the City.

3. How do I apply for a City of Placentia Business License Tax?

Contact the Finance Department to discuss the details of your business operation. Inquire about the City of Placentia zoning requirements for the type of business you will operate and its proposed location. This information may be obtained from the City Planning Division in the Development Services Department. In addition to obtaining a business license, you must also comply with all City, County and State regulations for zoning, building, health and safety. 5. What do I need to know about zoning?

Contact the City Planning Division to confirm that your business is compatible to those uses permitted in specific zoning districts. You may need additional use permit approval(s) and other permits and clearances prior to operating your business at the proposed location.

6. What if my business is home-based?

Every business conducted from a residence in the City of Placentia must have both a City Business License and a Home Occupation Permit. Home Occupation Permits can be obtained from the City Planning Division. The City Planning Division will review the type of business you are proposing to conduct to ensure that it is permissible within the residential district and will not have any negative impacts upon the surrounding neighborhood.

7. Do I need to display my business license?

All business licenses must be displayed on the premises. For those businesses not having a fixed address, the license must be physically carried on the person while conducting business and presented upon request.

8. Is my City of Placentia Business License Tax Transferable?

A Business License Tax is not transferable. It is the responsibility of the owner or operator to advise the Business License Tax Division of ownership changes, relocation or termination of business.

9. When is Business License due for renewal?

Once you have obtained a business license tax, a renewal will automatically be forwarded to the mailing address of record approximately 30 days before your expiration date. If you do not receive a renewal notice before the expiration date of the business license, please contact the Business License Tax Division. Failure to receive a renewal notice does not relieve the business owner of his/her responsibility in renewing the Business License Tax nor is it grounds for waiving any late penalties due.

10. How do I change the business address in the City?

To process a change of business address, advise the Business License Tax Division and request an application form to file an address correction or complete the online application.

11. How do I cancel the Business License Tax?

To cancel an existing Business License Tax, advise the Business License Tax Division in writing that you have ceased or will cease business or have or will sell your business or income property. Be sure to provide your business license tax account number and the date business has or will cease; you must sign your written notification. You may also make your cancellation notification by simply putting a ceased date on the Renewal Notification or your Notice of Business License Tax Due.

12. What is Fictitious Name or Doing Business As (DBA)?

Fictitious Names and DBAs are one in the same. If you propose to use a fictitious business name, contact the County Clerk Recorder and your local newspaper to schedule a publication of notice. Fictitious name statements are filed with the Orange County Clerk’s Office, located at 630 N. Broadway Street, (Building 12 in the Santa Ana Civic Center, Rm.101/ 106) Santa Ana, California 92702. 13. What is a Sales Tax Permit?

If you sell tangible personal property, you are required to obtain a Seller’s Permit (Retail Sales Tax Number) from the State Board of Equalization (SBE) for the purpose of collecting and reporting sales tax to the State of California. 14. What is a Federal Employer Identification Number?

If your business is organized as a corporation or partnership, or if you engage or plan to engage employees, you will need a Federal Employer Identification Number (FEIN) for the purpose of withholding FICA taxes and Social Security taxes. Parking and administrative citations cannot be paid directly to the city. These citations are handled by third party providers. Residences and businesses who have alarm systems must register them with the City of Placentia by obtaining an alarm permit. This assists public safety personnel in locating and responding to alarm systems. The fees associated with this permit include a $50 initial permit fee and a $25 annual renewal fee. 1. What are garage sales?

Garage sales are sales of personal property to the general public by means of “garage,” “yard,” “patio,” “rummage,” or other sales similarly conducted, which are temporarily-permitted accessory uses in a residential zone.

2. When are garage sales allowed?

Garage sales may only be conducted on the first full weekend (Saturday and Sunday) of March, June, September, and December between the hours of 8:00 am and 5:00 pm. 3. Where can garage sales occur?

Garage sales must be completely conducted on private residential properties occupied by the person(s) hosting the garage sale. Garage sales on properties containing multiple-family dwellings, properties owned or controlled by homeowner’s associations or property owners’ associations, and properties occupied by charitable or other nonprofit organizations or churches are permissible with prior permission from property owners. No person shall conduct a garage sale on public property or public rights of way (i.e., sidewalks, streets, alleys).

1. Are there any exceptions to the sanitary sewer maintenance fee?

Yes, depending on amount of water consumption and return flows to the sanitary sewer system. Please call the sanitary sewer fee question line at (714) 993-8119. You will be prompted to leave your name phone number and a brief question.

2. Why is my residence/business classified in a particular category?

Since the return flow contributed to the sanitary sewer system varies greatly based upon the type of application for the user being served, a separate rate has been developed for each class of user of the sanitary sewer system. The categories are based on the water districts classifications. If you have a residential meter your assigned sewer fee would correspond likewise.

3. If this is a City of Placentia fee why is the water company billing me?

The City of Placentia does not have the ability to bill customers. Since the fee is based on water consumption and return flows to the sanitary sewer system, an agreement has been created to have the water purveyors provide billing for the sanitary sewer maintenance fee.
